In no event shall justusbyrds.com be liable to a customer or any third parties for any direct, indirect, consequential, or resulting damages or injuries due to the failure of, the inability to access, the use of or otherwise arising out of the product for any lost profits, time, business, records, or other monetary damages, nor for any claim or demand against justusbyrds.com by any other person even if justusbyrds.com was or is made aware of the possibility of such damages or claim. The customer shall indemnify and hold justusbyrds.com harmless against any claims asserted by any third party against justusbyrds.com as a result of, or arising out of, the customer's use of the product. There are no warranties of merchantability or fitness for a particular purpose provided with the product. This limited warranty described above is exclusive and in lieu of all other conditions and warranties for the product. justusbyrds.com makes no other conditions or warranties, express, implied, statutory or otherwise, and expressly disclaims all other conditions and warranties including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose to the full extent permitted by applicable law.
